This Act enables the court, on the application of the Secretary of State, to disqualify a director if he is adjudged unfit to act as such. The criteria for unfitness includes whether the person has been held liable for:

Breach of duty
A transaction in fraud of creditors
Failure to comply with a duty to keep accounts and file audited accounts and annual returns
Fraudulent trading
Wrongful trading etc.
