Specific advice should always be taken on which division of the Court a case should be commenced. There are specialist divisions but in all of them as soon as a defence has been filed, the parties will have to complete “allocation questionnaires” indicating how they consider the case should be dealt with. The Court will allocate the case to one of three tracks:

1... Small Claims Track - cases under £5,000

2... Fast Track - most cases over £5,000 and under £15,000. The case must be suitable for a trial lasting no more than one day and be ready for trial within 30 weeks from allocation.

3... Multi-Track - most cases over £15,000 and cases where the claim is for something other than money.
