Most of the protocols refer to mediation and ADR. For example, the Protocol for Construction and Engineering Disputes provides that “in respect of each agreed issue or the dispute as a whole, the parties should consider whether some form of alternative dispute resolution procedure would be more suitable than litigation, and if so, endeavour to agree which form to adopt”.
